When you have purchased a property in Spain, or you are the holder of any other assets in Spain, such as bank accounts, life insurance policies, shares or any other type of financial products, it is of key importance to grant a Will in Spain, which will avoid future formalities, complications and additional costs related to the inheritance process.

Firstly, because the granting of a Will allows the testator to freely dispose of his properties and assets in Spain after his death, always according to the limits established by the legislation of his country of origin. To this regard, the testator shall appoint his inheritors and legatees and will determine the percentages allocated to each from the assets.

Passing away without a Will means that the distribution of the Spanish assets will be done according to the regulations of the country of origin, in this case, in what refers to the legal inheritors and the percentage allocated by the law to them.

Secondly, because through the Will some situations and circumstances ulterior to the death can be regulated. In the Will specific aspects related to the funeral of the deceased can be arranged (burial or cremation, place where the deceased will be buried or the ashes will be kept or disposed of, characteristics of the religious ceremony), and you can also appoint tutors or administrators for the children, when these are minor, fix conditions for the distribution of the assets and appoint executors who will ensure the fulfillment of those last wishes as detailed in the Will.

And thirdly, because it will make the process of allocation of the Spanish estate much quicker, easier and less expensive.

If a Will has already been granted outside Spain, it will be necessary to go, after the death, to the relevant Court Offices or Registry in the appropriate country to certify the validity of the same, having then to proceed to translate the said document into Spanish and get the Apostille or legalize it so that it becomes valid in Spain.

If no Will has been granted, in Spain or in the country of origin, the following steps will need to be taken:

In the country of origin, it shall be necessary to start the corresponding declaration of inheritors and administrators of the deceased´s estate, after the demise.

In Spain, when it is the parents, children, grandchildren or spouse of the deceased, they need to start before a Notary Public in Spain the proceedings of declaration of inheritors, which shall be settled strictly according to the laws of the country of the deceased. This process takes one month in being finalized.

And in the case when there may be only inheritors different from the above, such as cousins, nephews or nieces, uncles or aunts, or siblings of the deceased, the aforementioned proceedings for the declaration of inheritors will need to be undertaken via Court, with a longer period of resolution.

In the process of allocation of an inheritance in Spain the deadlines are of utmost importance, as the tax laws establish a period of six months, counting from the moment of the decease, to pay the relevant Inheritance Tax, and once the deadline expires, the amount of the tax shall be increased with a charge for paying outside the deadline and the relevant delay interests, if applicable.

Also, the management of any of the proceedings as aforementioned shall entail some expenses which involve an increase on the inheritance process cost: Notary’s fees, Court expenses, fees from the foreign Registries and Court Offices, costs for translation into Spanish of those documents which must translated and legalized to be valid in Spain. These fees and proceedings are not necessary when a Spanish Will has been granted, because once the relevant documents accrediting the decease and the estate of the deceased have been obtained, you would go directly to see the Notary Public to grant the corresponding Inheritance Deeds, without any need to start any of the aforementioned proceedings.

It is quite important to highlight that the costs of granting a Will in Spain are very low in comparison with the benefits it implies in the long term.

La Cala Health Clinic Has Moved

La Cala health clinic has moved and the new clinic is more spacious, modern and has more services.

Situated in Calle Sierra de las Nieves (past where the market is held – 2nd road on the right.)

As in all new buildings and services, there will surely be some details that still need polishing but in general all is running well.

The new clinic also includes an observation room and independent critical and emergency care.

It serves a population of 15,000 users with five family doctors, a paediatrician, three nurses and a nursing assistant making up the core team.

New technologies are also present as patients have their medical history on digital memory and may request an appointment in their appropriate areas, by phone (Salud Responde 902 505 060) by Internet via the Intersas website, or of course in person at the clinic.

Health Insurance Spain

We just wanted to write a quick post to mention Susan Warner at Health Insurance Spain.

When we moved back to Spain from the UK (where we had medical cover with Bupa) in 2007 I was 7 months pregnant. She was always at the end of the phone or email to answer any questions I had, and as a pregnant woman about to make a huge move aboard there were many!!

The Feria y Fiestas del Rosario, held annually in Fuengirola, starts on Thursday 6th October 2011 and runs until Wednesday 12th October, 2011.

The fairground opens each day of the Feria. It is situated mainly on the grounds where the market is normally held on Tuesdays between Fuengirola and Los Boliches, (the weekly market will not take place on Tuesday 11th October).

There are many interesting events held over the 7 days for all age groups and tastes and we have listed below some of the highlights which have been supplied to us and are correct, as far as we know, at this time. There is an attractive brochure with all the full information (in Spanish and partial English) which is available from the Tourist Office situated in Fuengirola (very near to the indoor market).

Of particular interest to families with children, is the fact that Monday 10th October is ‘Children’s Day’ and the funfair for the children has a 50% discount at the fairground.

The Feria in Mijas Pueblo started today and runs until Sunday 11th September 2011.

There are many interesting events held over the 5 days for all age groups and tastes and we have listed below some of the information which is available to us at the time of writing. This has kindly been supplied by the Mijas Foreign Residents Department.

Wednesday 7th September 2011
12pm Bell ringing and rockets announcing the festivity of the patron saint of Mijas, the Virgin of the Rock.
6:30pm Rockets announcing the start of the fair and Parade around the village
10:00pm Official opening of the casetas and lighting of the fair ground.
   
Thursday 8th September 2011
11:00am Special Mass at the Parish Church
2pm-7pm Inauguration of the Day Fair around the gardens (by the Parish Church).
6:00pm Musical Bands parade.
9:30pm Procession of the Virgin of the Rock with different musical bands.
At the end, a great firework display.
   
Friday 9th September 2011
1pm-8pm Music and dancing at the Constitution Square & the gardens area.
4:00pm Seniors Dominoes Championship at the Pensioners Residence.

The Mijas Local Police have opened an Information Office in Rivera del Sol with the aim to bring their work closer to the neighbours that reside in the large urbanization in this area of the Municipality.

This office, situated on Avenida del Golf, will be open from 9 pm to 2 pm, Monday to Friday. Attending the office will be a Local Police Agent and occasionally volunteer interpreters will be there to help foreigners place statements and other complaints.

The Local Government considers that this office will help “the local police to be closer to the neighbours of the Town and also improve the security” and this office will serve as a base for the services that the agents carry out in this area of the municipality.

The opening times are from Monday to Friday from 9am to 2pm – telephone 952 93 22 10

If you are interested in collaborating with the interpreter volunteer project that the Mijas Foreigners Department coordinates, please contact our office on 952 58 90 10 or via email frd@mijas.es  Volunteers are needed to cover the above service on Tuesdays and Thursdays from 10am until 12pm.
